Terms of Service

Effective date: August 14, 2026

These terms are the agreement between you and Totlio. You must affirmatively accept them when creating an account, and they govern your use of the Totlio app and website. We've kept them in plain English. Questions: hello@totlio.com.

What Totlio is

Totlio is childcare management software for family daycares, operated by Totlio LLC, a California limited liability company. Providers use it to manage enrollment, attendance, rooms, daily activity records, and family messaging; parents and guardians use it to stay connected with their provider and to pay tuition. Payments run through Stripe (see “Payments” below).

Totlio is a platform, not your childcare provider

Totlio is the software in the middle; we are not a party to the care relationship. Your provider is an independent business: the care they give, their tuition rates, schedules, enrollment decisions, and policies are between the provider and the family. Totlio does not supervise childcare, does not independently verify or guarantee a provider's licensing status, and does not set or guarantee tuition terms.

Provider responsibilities

Providers are responsible for maintaining all licenses, permits, approvals, insurance, and other legal requirements applicable to their childcare operations and services.

Accounts

Accounts are for adults (18+): providers, parents and guardians, and facility staff. You're responsible for keeping your login private and for what happens under your account. Role-based invitations (co-parent, authorized pickup, staff) grant real access to real families' information. Only send invite codes to people you intend to authorize, and revoke access when it should end.

Payments

Tuition disputes are between you and your provider

Totlio records payments; it does not judge them. If a family and a provider disagree about tuition (how much was owed, what was covered, whether care was delivered), that dispute is between them, and Totlio is not the arbiter. Payment disputes and chargebacks follow Stripe, bank, and card-network procedures; Totlio may provide transaction information or implement resulting payment adjustments. A chargeback does not decide the broader childcare dispute between the family and provider. We encourage families and providers to resolve billing questions directly; the payment history in the app is there for both sides.

Acceptable use

Don't misuse Totlio. That includes: accessing information about children or families you're not authorized for; sharing invite codes with people who shouldn't have them; uploading content that's unlawful or abusive; using the platform to harass; attempting to probe or break the security rules; or using Totlio for anything other than childcare management. We can suspend or terminate accounts that put families' information or money at risk.

Content and photos

Providers and families own what they upload. By uploading, you give Totlio the limited permission needed to host, store, transmit, and display that content as needed to operate Totlio for the authorized circle it belongs to. By uploading a photo or other content, you represent that you are authorized to upload and share it with the applicable authorized circle and have obtained any permission required by law, provider policy, or agreement with the child's parent or guardian.

Ending your account

You can stop using Totlio anytime and request account deletion from Settings in the app; deletion is completed within 7 days, subject to the limited retention described in the Privacy Policy. Providers with children on their roster must close out those enrollments first. We may suspend or terminate accounts for violations of these terms; if we do, the same deletion and retention rules apply.

Disclaimers and limitation of liability

Totlio is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted availability. To the maximum extent permitted by law, Totlio's total liability for any claim arising out of these terms or the service is limited to the greater of $100 or the service or platform fees actually paid by you to and retained by Totlio in the twelve months before the claim. For clarity, this cap does not include childcare tuition or amounts payable to a provider. Totlio is not liable for indirect, incidental, or consequential damages, or for the acts or omissions of childcare providers, families, or Stripe. Nothing in these terms limits liability for fraud, willful misconduct, gross negligence, or other liability that applicable law does not permit Totlio to limit.

Indemnification

To the extent permitted by law, you agree to indemnify, defend, and hold Totlio and its officers, employees, and agents harmless from third-party claims arising from childcare services you provide, including licensing or regulatory violations; content you upload or share without required authorization; infringement or violation of another person's intellectual property or privacy rights; or your intentional misuse of Totlio. This obligation applies only to the extent the claim results from your conduct and does not require you to indemnify Totlio for Totlio's own fraud, willful misconduct, or gross negligence.

Governing law

These terms are governed by the laws of the State of California. Any dispute arising out of or relating to these terms or Totlio may be brought in a court of competent jurisdiction, subject to applicable law regarding jurisdiction and venue.

Changes to these terms

If we make material changes, we'll notify account holders in the app or by email before the changes take effect and update the effective date above. Continued use after the effective date means the updated terms apply.
